OMI Solutions (Pty) Ltd (OMI) was appointed by the Dainfern Valley Homeowners Association (DVHA) to compile an Environmental Impact Report (EIR) and Environmental Management Programme (EMPr), as part of the rectification application process in terms of Section 24G of the National Environmental Management Act (Act 107 of 1998) (NEMA) (hereafter referred to as the Section 24G Rectification Application) for the unlawful commencement or continuation of an activity identified in terms of the Environmental Impact Assessment (EIA) Regulations, 2014, as amended.

Dainfern Valley Estate is a residential estate located north of Johannesburg along the R511 towards Diepsloot within the City of Johannesburg Metropolitan Municipality, Gauteng. It is understood that the DVHA commenced with rehabilitation of the riverbanks of the Jukskei River in 2017, with rehabilitation activities gaining momentum in April 2018. The unlawful activity, which involves the infilling of material along the banks of the Jukskei River as part of the rehabilitation efforts to stabilise the riverbanks and control erosion, is identified as a listed activity in the EIA Regulations as follows:

• Listed Activity in terms of Listing Notice 1 (GNR 983) of 2014 (as amended) - Activity 19: The infilling or depositing of any material of more than 10 cubic metres (m3) into, or the dredging, excavation, removal or moving of soil, sand, shells, shell grit, pebbles or rock of more than 10 m3 from a watercourse.
• Activity details - Rehabilitation activities stabilised the riverbank and controls erosion through soft scaping, and/or by means of manageable on-site hard materials and planting of local vegetation. It is estimated that over 10 m3 of rip-rap material was used to infill the eroded riverbanks.
• Timeframe when physical activity commenced - The activity commenced in April 2018.

The aim of the EIR is to assess the nature, extent, duration and significance of the consequences for or impacts on the environment due to the activity, including the cumulative effects and the manner in which the geographical, physical, biological, social, economic and cultural aspects of the environment may be affected by the unlawful activity. In addition, the EIR includes a description of the public participation process followed during the Section 24G Rectification Pre-application process, including all comments received from interested and affected parties and an indication of how the issues raised have been addressed, as well as the proposed public participation process to be followed following submission of the Section 24G Rectification Application. The attached EMPr provides a description of the mitigation measures undertaken or to be undertaken in respect of the consequences for or impacts on the environment due to the activity.
